Bye Bye

Bob Bauer says “bye” to the “recess three” FEC Commissioners. So does Brad Smith.

I have little to add.  I believe Commissioners Lenhard and Von Spakovsky were conscientious, smart, and properly restrained.  I would expect that Lenhard will continue to serve the “regulated community” and that CVS will gain the respect in the private sector that has heretofor eluded him.

Admit it - if his name wasn’t remiscent of Rocky and Bullwinkle’s “Boris Badenov,” certain folks wouldn’t have such a good time on the attack.  At least Brad Smith has a relatively bland name going for him, provided people didn’t think he was this guy.
Commissioner Walther, being from Nevada, must be a worthy person. Now the FEC will run sans Commissioner input, I suppose, which means the Staff Director and the General Counsel better be getting along these days!

More Evidence That the State Spending Limits Are Stupid

Obama v. Edwards: The Memo.  To quote:

The groups supporting Edwards have spent over $2 million including efforts organized by one “independent” organization run by one of Edwards’ highest-ranking political aides which newspapers reported today received a questionable 11th-hour donation of $495,000 just days ago.

So, has Edwards “coordinated” 527 spending?  One would think that the Edwards people have some sense of the legal restrictions there, and the memo doesn’t exactly assert “coordination” since it relies instead on screaming “loophole.”  But why, then the “scare quotes” around “independent?”

Moreover, the “sleazy lawyer money” accusation seems to stick to Edwards:

In their most recent financial disclosure, the Alliance for New America revealed that they had raised $495,000 from Oak Springs Farms, LLC. Oak Springs is funded through the assets of Rachel Mellon, who is 97-years old.  According to the available records, which go back to 1980, she has never donated to a political candidate until a contribution was made in her name to John Edwards this year. Mellon’s involvement in the decision to donate to the Edwards campaign is unknown. The Washington Post reported yesterday that Alexander Forger, who has power for attorney for Mrs. Mellon, is a major supporter of John Edwards’ candidacy.

Politico’s contribution here. Mr. Forger is a big-time trust and estates lawyer (he received an American Lawyer lifetime achievement award)  He was the replacement trustee in the Doris Duke mess.  As estate planning counsel to the liberal plutocracy one wonders why he supports Edwards, but perhaps politics is more complicated than that . . .

Am I Blue?

I haven’t said anything about the ActBlue defeat (the FEC denial of their request asking that individual contributions to participating presidential candidates raised through the site be matched with public funding).  These people have.

It is clear to me that the FEC has produced a correctly reasoned, appropriately narrow construction of the statutes and its regulations, that pleases just about nobody.  If the statute intends to encourage donations from low-to-middlin’ donors (only the first $250 is matched) it should matter little that the money came through a site like ActBlue, rahterh than through the candidate’s own site.

Having said that, the regulations are clear about the documents required for a matching payment.  ActBlue’s contributions forwarding routine didn’t fit the bill.

Wishful critics have been quoted as  tut-tutting the Luddite FECA for insufficient modernity.  True, the underlying Act predates the Internet, but the regulations do not.  In fact, the specific provisions that set out what a candidate needs to produce to obtain a matching payment mentions the Internet explicitly.  (Look it up - 11 C.F.R. 9034.2(c) & 9036.1(b)(7) for starters).

I like laws that encourage contributions as much as anybody - but I also like the FEC taking seriously its obligations to interpret the statute and regs consistently, and resisting the temptation to amend rules via Advisory Opinions.  I don’t care much for the result, either.  Perhaps Reid and Pelosi can do better.
